On February 20,1981, Joseph Rogers was charged by a Bill of Information with violation of R.S. 14:62.2, simple burglary of an inhabited dwelling. Defendant pled not guilty. Subsequently, a jury trial was had and a guilty verdict was returned.1 On appeal, Rogers contends the trial court erred in failing to: (1) instruct the jury, at its request, on responsive verdicts, and (2) grant a motion for a new trial.
