OPINION

TIJERINA, Justice.

This is an appeal from a conviction for engaging in organized criminal activity, towit: theft of property of a value of more than $200.00 and less than $10,000.00, a violation of Tex.Penal Code Ann. § 71.02 (Vernon Supp. 1982-1983). Punishment was assessed at five (5) years' confinement in the Texas Department of Corrections and a fine of $2,000.00.
