I. Introduction

This case is before the Court on cross motions for summary judgment. Plaintiff, the Center for Auto Safety (the "Center"), requests declaratory and injunctive relief requiring the Defendant, the Department of Justice ("DOJ" or the "Government"), to release certain documents requested by it under the Freedom of Information Act ("FOIA").1
