PER CURIAM.

Defendant Jerry Johnson was charged by grand jury indictment with aggravated rape, in violation of La.R.S. 14:42. At the conclusion of trial on December 14, 1972, the jury returned a qualified verdict of guilty without capital punishment, thereby prompting the trial court's sentencing of defendant to life imprisonment at hard labor. This Court affirmed the conviction and sentence on appeal. State v. Johnson, 322 So.2d 119
