Plaintiff-appellee, Marvin Blanchard, d.b.a. A-1 Asphalt, filed an action against James Morgan, d.b.a. Morgan Memorial Home, on February 6, 1979, in the Portage County Municipal Court. After an answer was filed, but before the trial was called, Morgan died on August 9, 1979. Trial of the matter was held on October 24, 1979. Mary Morgan appeared at trial, was substituted as a party-defendant for her deceased husband, and testified as a witness.
