This cause is before this Court on a direct appeal from a decision of the First District Court of Appeal in Southeast Volusia Hospital District v. State of Florida, Department of Insurance,432 So.2d 592 (Fla. 1st DCA 1983), which declared section 768.54(3)(c), Florida Statutes (1981), unconstitutional. We have jurisdiction. Art.
