The Plaintiff, McCain Foods, Inc., appeals from an order of the Superior Court (Aroostook County) entered on December 15, 1982, which granted a motion of the Defendant, Victor St. Pierre, for judgment notwithstanding the verdict. We sustain the appeal because we conclude (1) that the issues were tried to the jury by consent of the parties pursuant to M.R.Civ.P. 39(d), and (2) that there was credible evidence supporting the jury's verdict in favor...
