On May 18, 1981, the defendant, Charles Washington, was charged with possession with intent to distribute pentazocine (Talwin), then a violation of LSA-R.S. 40.969.1

The jury returned a verdict of guilty as charged and the defendant was sentenced on August 7, 1981 to serve 31/3 years in the custody of the prison with credit for time served. On December 28, 1981, the defendant was resentenced as a multiple offender...
