Plaintiff, a Midshipman at the United States Merchant Marine Academy in Kings Point, New York (hereinafter "the Academy") brought this action for declaratory and injunctive relief after the Academy refused to change an examination grade fixed at "zero" because of plaintiff's alleged cheating, despite a finding by the Academy's Honor Board exonerating him of that charge.
