Plaintiff, a Virginia citizen, brings this action for breach of statutory contract and for recovery of a statutorily provided refund against Oppenheimer & Co., Inc., a Delaware corporation whose principal place of business is in New York. As the amount in controversy exceeds $10,000, the Court has jurisdiction pursuant to 28 U.S.C. § 1332(a). The matter comes before the Court on cross-motions for summary judgment...
