The defendant is before the court for sentencing, having been convicted of intentional murder in the second degree (Penal Law, § 125.25, subd 1), felony murder in the second degree (Penal Law, § 125.25, subd 3), sexual abuse in the first degree (Penal Law, § 130.65, subd 2) and criminal possession of a weapon in the fourth degree (Penal Law, § 265.01, subd 2).
