THOMAS v. KNIGHT

No. 83 CA 1045.

442 So.2d 750 (1983)

Percy T. THOMAS v. Larry D. KNIGHT.

Court of Appeal of Louisiana, First Circuit.

November 22, 1983.

Attorney(s) appearing for the Case

Donald Fendlason, Bogalusa, for plaintiff.

Delos Johnson, Franklinton, for defendant.

Before PONDER, WATKINS and CARTER, JJ.

CARTER, Judge.

This Court, ex proprio motu, issued a rule to show cause why this suspensive appeal from a judgment of eviction should not be dismissed as untimely filed.

On May 16, 1983, plaintiff, Percy T. Thomas, filed an eviction proceeding against defendant, Larry D. Knight. Defendant did not file an answer to this rule to show cause, but at the hearing held on June 27, 1983, sought to establish an affirmative defense to the eviction proceeding.
