LEMMON, Justice.
This is an appeal from a conviction of simple burglary and a sentence of four years imprisonment. The principal issue is whether defendant's motion for mistrial was properly denied when the trial, which began before a jury of 12 persons, was allowed to be concluded before the jury composed of the first six jurors chosen and the verdict was deliberated and rendered by those six jurors.
