On September 23, 1981, a Sullivan County Grand Jury handed down an indictment charging petitioner with two counts of manslaughter in the first degree in violation of subdivision 2 of section 125.20 of the Penal Law (killing under the influence of extreme emotional disturbance). One count charged him with killing his wife and the other with killing her alleged paramour. These killings were alleged to have occurred on September 13...
