Following a trial by jury and a verdict for the defendants, the trial judge granted a motion for a new trial on behalf of plaintiff. At the same hearing when the motion for new trial was granted, the court proceeded immediately to direct a verdict in favor of plaintiff as to liability, then set a date for a new trial as to quantum alone.
