This is a plea-of-privilege case. Appellee Byrd brought suit against appellant Beacon National Insurance Company, to recover a fire loss under a homeowners' policy, and for recovery under the Texas Deceptive Trade Practices and Consumer Protection Act for an alleged "false, misleading and deceptive act."
