Judgment affirmed.

The case is remitted to the County Court, Suffolk County, for further proceedings pursuant to CPL 460.50 (subd 5). The People sustained their burden of proving that defendant's brother had authority to permit entry into the home which he jointly occupied with defendant, that on May 16, 1981, at approximately 7:00 A.M., he voluntarily consented to the police officers' entry into the home (People v Cosme, 48 N.Y.2d 286
