BISSETT, Justice.

This is an appeal from a conviction for aggravated assault. Appellant, Mario Pena (Pena), pleaded guilty to the trial court and true to allegations that he had previously been convicted of a felony. Pursuant to a plea bargain, the court assessed punishment at five (5) years and appellant was sentenced to confinement in the Texas Department of Corrections for a term of not less than two (2) nor more than five (5) years.
