Defendant was indicted by a Warren County Grand Jury in a single-count indictment charging criminal sale of a controlled substance in the third degree, a class B felony. Only two witnesses testified at the trial of the indictment, State Police Investigator Kenneth Cook and a police chemist who established that the two packets allegedly sold to Cook contained cocaine.
