As a result of an incident which occurred at approximately 8:36 P.M. on December 16, 1980 at 345 Hudson Avenue in the City of Albany wherein defendant allegedly knowingly entered and remained in a dwelling with the intent to commit a crime therein, defendant was indicted on one count of burglary in the second degree (Penal Law, § 140.25, subd 2).
