NYE, Chief Justice.

This is an appeal from an order revoking probation. On July 16, 1981, the appellant was convicted, on his plea of guilty, of the charge of burglary of a habitation. In accordance with a plea bargain, the trial court assessed punishment at five years in the Texas Department of Corrections and placed defendant on probation for five years and a fine of $250.00.
