Both Rose Chodikoff, 78 years old, and her husband Max, over the age of 85, were admitted to plaintiff Samaritan Hospital for treatment of their acute illnesses on December 11, 1980. They remained in the hospital until January 1, 1981. Mr. Chodikoff's Medicare benefits were terminated on December 15, 1980, making him liable for a hospital bill totaling $1,607.15.
