In a jury trial, and on his plea of not guilty, appellant was found guilty of theft of more than $10,000, a second degree felony. Punishment was assessed by the jury at confinement in the Texas Department of Corrections for ten years and imposition of a fine in the amount of $10,000, with a recommendation that imposition of sentence as to confinement be suspended and that appellant be placed on probation.
