MEMORANDUM OPINION AND ORDER

This action is brought by the Federal Deposit Insurance Corporation (FDIC) against Robert Rodenberg, guarantor of several notes which were purchased by the FDIC from a bank in distress under 12 U.S.C. § 1823.
