This case is a direct appeal from the defendant-appellant's (defendant) Juan L. Baca's conviction of first degree murder. On April 26, 1979, the defendant was indicted for the shooting death of Toby Baca. Joe "Shuske" Baca, not a party to this appeal, was indicted for aiding and harboring the defendant.
