This is an action for declaratory judgment brought by plaintiff, a Rensselaer County Legislator and taxpayer, against defendants, who are fiscal officers of the county, wherein a declaration is sought that defendants violated sections 25.00 and 165.00 of the Local Finance Law by transferring money lawfully in a segregated account and commingling said funds with the general county funds.
