MEMORANDUM AND ORDER

NEAHER, District Judge.

Plaintiff, Richard Cepulonis, filed this pro se action under 28 U.S.C. § 1346(a)(2),1 alleging a seizure and forfeiture of his automobile in violation of the due process clause of the Fifth Amendment. He seeks declaratory relief and money damages in the amount of the appraised value of the vehicle.2
