This case arose out of a breach of an oral contract entered into between plaintiff-appellee, Universal Dynamics, and defendants-appellants, Loftin Construction Company, Inc. of Westlake, and Walter Loftin,2 for the excavation of dirt by defendants from plaintiff's property.
