This appeal arises from an employment discrimination suit timely brought pursuant to section 706 of Title VII, 42 U.S.C. § 2000e et seq., and 42 U.S.C. § 1981. Plaintiff Jones alleged that he was discharged after nearly five years as Western's employee because he was black and that Western maintained discriminatory policies and practices. The district court found that the plaintiff had failed to present the existence of a genuine issue...
