On May 30, 1975, plaintiff was injured in a motor vehicle accident and, thereafter, commenced this action to recover for personal injuries. The case proceeded to trial and at the completion of plaintiff's case defendant contended that plaintiff had failed to establish that he had suffered a serious injury within the meaning of subdivision 4 of section 671 of the Insurance Law (all references hereinafter are to the Insurance Law) as it read at the time of the accident.
