Judgment modified, as matter of discretion in the interest of justice, by reversing the convictions of criminal possession of a controlled substance in the third degree (three counts), and vacating the sentences imposed thereon, and the said counts are dismissed. As so modified, judgment affirmed. Appeal from the order dismissed (see People v De Jesus, 54 N.Y.2d 447).
