The complaint on which this case is based was filed in the Superior Court in November, 1976, and contained allegations (count 1) that certain of the actions of the defendant Phoenix Investment Counsel of Boston, Inc. (Phoenix), regarding investment counseling services, constituted "unfair and deceptive acts and practices in the conduct of trade and commerce" and were violations of G.L.c. 93A, &...
