This is a criminal case in which the Commonwealth appeals from a lower court order dismissing the charges against appellee Reihart pursuant to Pa.R.Crim.P. 1100. A criminal complaint charging Reihart with homicide by vehicle and involuntary manslaughter was issued on August 20, 1980. A preliminary hearing was scheduled for September 12, 1980, however, a Commonwealth witness, Mark Long, was seriously ill; the hearing was continued until January 27...
