This is an appeal from an order sustaining a plea in abatement. Appellant, Peak Pipeline Corp. (Peak), constructed a pipeline in Cherokee County across land owned by appellees, Charles Norton, Laurie T. Norton, James D. Norton and William L. Norton (Nortons), without their permission and without condemning the land in question.
