The petitioner-appellee, Great Circle Lines, Ltd. (Great Circle), sought arbitration in New York against respondent-appellant Matheson & Co., Ltd. (Matheson). When Matheson failed to appoint an arbitrator, petitioner commenced the subject action pursuant to 28 U.S.C. § 1333(1) and 9 U.S.C. § 1.
