MEMORANDUM AND ORDER

HATFIELD, District Judge.

Petitioner, Howard L. Bashor, was convicted of the offense of deliberate homicide on June 18, 1978, following a jury trial in state district court in Toole County, Montana. Petitioner was subsequently sentenced to the Montana State Prison for a term of thirty years, with ten years suspended. On appeal, the Montana Supreme Court affirmed the petitioner's conviction.
