Soper, the plaintiff/landlord, brought an unlawful detainer action against Clibborn, the defendant/tenant. The trial court dismissed Soper's action because of inadequate notice, and dismissed Clibborn's counterclaim for damages as an inappropriate adjunct to an unlawful detainer proceeding.
