MEMORANDUM OPINION AND ORDER

GETZENDANNER, District Judge.

Plaintiff Donnell McCowen instituted this civil action pursuant to 42 U.S.C. § 1983 (1976). He alleges that he promised sometime in 1978 to repair and restore defendant Homean Baxter's "junk condition" 1966 Porsche automobile. In return, Baxter agreed to assign McCowen a 1961 Mercedes-Benz 190 SL automobile, also in "junk condition." During the next year or so McCowen worked on both cars. However...
