CLINTON, Justice.

This appeal arises from an application to the District Court for Douglas County for post conviction relief under the provisions of Neb.Rev.Stat. §§ 29-3001 et seq. (Reissue 1979). The District Court denied an evidentiary hearing and the relief requested on the ground that the files and records in the case showed that the applicant was entitled to no relief. § 29-3001; State v. Gero, 186 Neb. 379
