Scott A. Lewis, the minor son of Bobby and Jennifer Lewis, died after he was struck by a pickup truck in a neighbor's driveway on Madeline Street in Alexandria, Louisiana, at about 4:30 p. m. on July 7, 1979. The parents filed suit, averring negligence on the part of the minor driver of the pickup, Michael Till. Also made defendants were Till's parents (Mr. and Mrs. Eubanks) and their alleged insurers.
