In this case, Vernita I. McMahon sought to recover damages from Linwood Lee Wells for personal injuries she sustained on August 26, 1978, when her automobile was struck from behind by a vehicle operated by Wells. Defendant denied any negligence and alleged that McMahon was guilty of negligence which was the sole proximate cause of the collision. At trial, each party moved to strike the other's evidence.
