HALL, Chief Justice:

Defendant appeals his conviction of the offense of kidnapping a minor, a felony of the third degree.1 His contentions of error are that: 1) the trial court improperly refused to instruct the jury that the offense of unlawful detention is a lesser included offense; 2) the evidence was insufficient to prove the minority of the victim; and 3) that his alleged acts constituted the misdemeanor
