The indictment charges defendant with 18 separate counts of promoting an obscene sexual performance by a child (Penal Law, § 263.10).

In a memorandum decision dated January 28, 1982 (People v Godek, 112 Misc.2d 512), this court held, inter alia, that the statute was constitutional.
