James Carroll Batchelor died intestate on August 4, 1980, survived by his widow, Judith Ann Batchelor, appellee herein, a brother, Charles E. Batchelor, and two legitimate sons, James Carroll Batchelor, Jr., and James Keith Batchelor. Both the brother, Charles E.
