This is a breach of contract case.

Plaintiff, Alpha Coal Company, brought an action against defendant, National Cement Company, for breach of contract. The case was submitted to a jury which determined the issues in favor of the plaintiff and awarded it damages. Subsequent to the jury verdict the plaintiff made a motion for a new trial on the basis of the inadequacy of the damages. The motion was denied and the plaintiff appeals to this court...
