The defendant was originally indicted on one count of attempted murder in the second degree, two counts of assault in the second degree, and one count of robbery in the first degree. There was a jury trial in 1977, and the defendant was convicted of attempted murder in the second degree and assault in the second degree. This court reversed and remanded for a new trial (67 A.D.2d 219), on the basis that the defendant's right to call witnesses...
