Albert Powell (Powell) brought suit against Flotation Services, Inc. (Flotation) seeking past due wages, penalties and attorney's fees under the provisions of LSA-R.S. 23:631 and 632.1 The trial court rendered judgment in favor of Powell in the amount of $370.18 as past due wages and attorney's fees in the amount of $750.00. Statutory penalties were denied by the trial court which recognized the equitable defenses raised...
