After pre-hearing conference upon appeal from the Circuit Court for Baltimore County, the parties agreed to the following statement of facts:

"This case involves the suit of the parents and personal representative of the deceased minor. On January 11, 1980, the minor, Anthony Rispoli, was driving south on Interstate 95 in a van at about 5:25 P.M., in the rain, in the right-hand or slow lane just past the border...
