Defendant was convicted on December 13, 1979, of delivery of less than 50 grams of heroin in violation of MCL 333.7401(2)(a)(iv); MSA 14.15(7401)(2)(a)(iv), following a jury trial. He was subsequently convicted as a habitual offender, fourth offense. MCL 769.12; MSA 28.1084. He was sentenced to serve a term of 10 to 20 years in prison. Defendant appeals as of right.
