OPINION

YOUNG, Justice.

This is an appeal from a conviction for aggravated rape. Punishment was assessed by the jury at ninety-nine years confinement in the Texas Department of Corrections and a $10,000.00 fine.

The sufficiency of the evidence is not challenged. The defendant was convicted for the aggravated rape of a female on October 28, 1980, at the DeTar Hospital in Victoria, Texas. She positively identified the defendant as the man who raped...
